These Terms govern your use of Daktalink websites, mobile applications, and related services (“Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What we provide
Daktalink offers health information, education, and tools (such as symptom guidance, facility directories, and optional telemedicine workflows). Unless a licensed doctor treating you through the platform tells you otherwise in a proper clinical context, nothing in the Services is a medical diagnosis or prescription.
2. Not emergency care
The Services are not a substitute for emergency services. If you may be having a medical emergency, call your local emergency number or go to the nearest emergency department immediately.
3. Eligibility and accounts
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly if you suspect unauthorised access.
4. Acceptable use
You agree not to misuse the Services, including by: attempting to break security; scraping or overloading systems; harassing users or staff; uploading malware; impersonating others; or using the Services in violation of law. We may suspend or terminate access for violations.
5. Doctors and roles
Doctor or staff features may require verification and approval. You represent that any professional information you supply is truthful. We may refuse or revoke access when necessary for safety, fraud prevention, or regulatory reasons.
6. Subscriptions and payments
Paid features, if offered, are subject to the pricing and renewal terms shown at purchase. Third-party payment processors handle card or wallet data according to their policies.
7. Intellectual property
Content, branding, software, and materials we provide are owned by us or our licensors. We grant you a limited, revocable licence to use the Services for personal, non-commercial purposes unless we agree otherwise in writing.
8. User content
You retain rights to content you submit. You grant us a licence to host, process, and display that content as needed to operate the Services (for example showing your telemedicine message to the doctor you selected).
9. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available”. We disclaim implied warranties where allowed. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, we and our suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve months before the claim or (b) a modest fixed amount where no fees applied, except where liability cannot be limited by law.
11. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Services, your violation of these Terms, or your violation of others’ rights, to the extent permitted by law.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Courts in Nigeria have non-exclusive jurisdiction unless mandatory consumer rules say otherwise.
13. Changes
We may modify these Terms. We will post updates on this page and may give additional notice for material changes. Continued use after the effective date constitutes acceptance.
